About these terms

These terms govern your use of monostroke.com and purchases from Monostroke. Monostroke is operated by Jovial Yellow LLC. By using the store or placing an order, you agree to these terms, our Privacy policy, Shipping policy, and Return and refund policy.

Our store is hosted by Shopify, which provides the commerce platform we use to offer products and accept orders.

Eligibility

You must be able to enter into a binding contract where you live. If you place an order for a minor, you confirm that you are the parent, legal guardian, or otherwise authorized to do so.

Products and orders

We offer personalized framed paper portraits based on customer supplied photographs or original writing. Product descriptions, available sizes, and current prices appear on the product page. We may correct an obvious pricing, description, or availability error before fulfilling an order. If we cannot fulfill an order after payment, we will contact you and provide an appropriate refund.

An order confirmation means that we received your order. We may decline or cancel an order for suspected fraud, payment failure, prohibited content, rights concerns, technical error, or inability to fulfill it. If we cancel a paid order, we will refund the amount owed.

Prices and payment

Prices are shown in United States dollars unless the store clearly states otherwise. Shipping to US addresses is free. Applicable taxes are shown at checkout. You authorize us and our payment providers to charge the payment method selected at checkout.

Customer photos and other content

You keep ownership of photos, names, dates, instructions, and other content you submit.

You confirm that you own the submitted content or have sufficient permission from the copyright owner to use it for your order. Permission from a person shown in a photo does not replace permission from the photographer. You also confirm that you have the consent needed for recognizable people shown in the content. For a minor, you must be the parent or legal guardian or have their authorization.

You grant us a limited, nonexclusive, worldwide, royalty free license to receive, store, process, adapt, reproduce, and share the submitted content only as reasonably necessary to prepare proofs, make revisions, print and fulfill the order, provide support, prevent fraud, comply with law, and operate the service providers involved in those activities. We will not use your submitted photo in advertising without separate permission from you. Retention and deletion practices are described in our Privacy policy.

Prohibited content

Do not submit content that is unlawful, threatening, abusive, sexually exploitative, invasive of privacy, or that infringes copyright, trademark, publicity, or other rights. Do not submit celebrity images, branded characters, logos, or professional photography unless you have the rights needed for that use. We may refuse content that creates a legal, safety, or fulfillment concern.

Proofs, revisions, and approval

We prepare a proof before printing. Before you approve, you may ask for changes as often as you need, as described in our Return and refund policy. Orders placed under earlier terms keep the review terms offered when the order was placed. You are responsible for reviewing the proof, including the portrait, crop, size, names, dates, spelling, and other requested details. Printing begins only after your approval and our final studio check.

If you do not respond to approval requests, the order may remain paused. We may cancel and refund an order that cannot proceed after reasonable attempts to contact you.

Cancellations, refunds, and remedies

You may cancel for a full refund within 24 hours of placing your order, before the studio starts preparing your artwork, as described in our Return and refund policy. After that, personalized items cannot be cancelled, and they are not returnable for a change of mind, except where applicable law provides otherwise. Damaged, defective, or incorrect items are handled under the Return and refund policy.

Shipping

We currently accept delivery orders only for the United States. Available destinations, charges, estimates, tracking, address changes, and delay handling are described in our Shipping policy.

Product appearance

Screens and lighting can affect color. Print placement and production may involve small variations. Product dimensions and materials are described as accurately as reasonably possible. Nothing in this section limits remedies for a damaged, defective, or incorrect item.

Store conduct

Do not misuse the site, interfere with its operation, attempt unauthorized access, introduce malicious code, scrape protected areas, or use the store for unlawful activity. We may restrict access where reasonably necessary to protect customers, the store, and our service providers.

Our intellectual property

The Monostroke name, site design, copy, graphics, and original store materials are owned by us or used with permission. These terms do not grant you a license to use our brand or materials beyond viewing the store and using it for personal shopping.

Third party services and links

The store uses third party services for commerce, payments, hosting, file handling, production, fulfillment, analytics, and support. Their services may have separate terms and privacy practices. Links to third party sites are provided for convenience, and we are not responsible for content we do not control.

Disclaimers and limits

We do not exclude any warranty, remedy, or liability that cannot lawfully be excluded. To the fullest extent permitted by law, the store and services are provided without implied warranties beyond those that apply by law. We are not liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable. Our total liability relating to an order will not exceed the amount you paid for that order, except where applicable law requires otherwise.

You agree to be responsible for claims resulting from content you submit or your material breach of these terms, to the extent permitted by law.

Changes

We may update these terms for legal, operational, or service changes. The effective date above shows the current version. Changes apply prospectively unless law requires otherwise.

These terms are governed by the laws applicable to the store operator and the transaction, without limiting mandatory consumer protections that apply to you.
